Copyright vs Creative commons

Last class in Second life we were talking about copyright and creative commons,

Creative commons definition: ” The idea of universal access to research, education, and culture is made possible by the Internet, but our legal and social systems don’t always allow that idea to be realized. Copyright was created long before the emergence of the Internet, and can make it hard to legally perform actions we take for granted on the network: copy, paste, edit source, and post to the Web. The default setting of copyright law requires all of these actions to have explicit permission, granted in advance, whether you’re an artist, teacher, scientist, librarian, policymaker, or just a regular user. To achieve the vision of universal access, someone needed to provide a free, public, and standardized infrastructure that creates a balance between the reality of the Internet and the reality of copyright laws. That someone is Creative Commons.”  http://creativecommons.org

Copyright definition: “Copyright, protects a form of intellectual property law, protects original works of authorship including literary, dramatic, musical, and artistic works, such as poetry, novels, movies, songs, computer software, and architecture. Copyright does not protect facts, ideas, systems, or methods of operation, although it may protect the way these things are expressed. See Circular 1, Copyright Basics, section “What Works Are Protected.”

We were talking about copyright infringement and we use a cd that I design for free in 2010 for a band The Rambleers” I took the photos and design the cd, I didn’t sign any copyright agreement, and the image of the cd cover is starting to appear in different websites , even in iTunes , what right do I have as the artist who design that image?

There were few steps towards this case:

Prove that the work is mine, I have a blog where I record every work that I have done for me or others, so here is the link. http://quene.wordpress.com/2011/01/15/the-making-of-the-rambleers-album-cover/

Talk to the band or companies that have use my design.

1 Response to Copyright vs Creative commons

  1. Locks says:

Hi Q, Good start on your take on creative commons and copyright. Would be interesting to see you delve abit deeper as to the ways in which cc or copyright would suit your work going forward especially considering your experience. What would suit you and your work and why?
What do you speculate could come of you contacting those who have used your work without permission?
